Bates v. MPW Industrial Services, Inc.

Introduction          
    On August 9, 2007, Robert Bates, Brian Anderson & Eric Watkins filed a complaint against MPW Industrial Services, Inc. (“MPW”), on behalf of themselves and all other hourly employees in the Industrial Cleaning Services (“ICS”) division reporting to Decatur or Pelham, Alabama; Brunswick, Georgia; or Fernandina Beach, Florida, locations.  This case was filed in the Northern District of Alabama, Case Number CV-07-J-1441-NE. 

    These Plaintiffs allege that MPW violated the Fair Labor Standards Act, 29 U.S.C. Sec. 216, et. seq. by failing to pay them for all of the hours that they worked for MPW.  Specifically, the Plaintiffs allege MPW failed to pay its employees for certain time doing the following:

  • waiting to be called to work
  • preparing to go to customer locations
  • traveling between branch locations and customer locations
  • traveling between jobs at different customer locations
  • time spent donning and doffing (putting on and taking off) protective clothing
